Acceptance of Terms: By using the getjoystick.com website, or any services under the getjoystick.com domain, including app.getjoystick.com, docs.getjoystick.com, (known collectively as "service"), you agree to be bound by these terms of use and all terms incorporated by reference. If you do not agree to these terms, you may not access or use the platform. These terms will change from time-to-time and we will do our best to inform current users if there are material changes. Please check back here from time-to-time for the latest terms.

Registration and Security: To access some features of the platform, you may be required to register and set up an account. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account.

Use of Service: You may use the platform only for lawful purposes and in accordance with these terms of use. You agree not to use the platform to:
a) upload, post, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable;
b) impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity;
c) interfere with or disrupt the service or servers or networks connected to the service;
d) violate any applicable local, state, national, or international law;
e) use the platform in any manner that disrupts or may cause disruption/degradation service for other users of the service;

Usage Limits: Your use of the service is subject to usage limits as specified in your account settings or as communicated to you by us. You agree not to exceed these usage limits, or we reserve the right to suspend or terminate your account. These usage limits and pricing may be adjusted from time-to-time. We will make reasonable efforts to notify Organization Owners via the platform, and/or the email address associated with their account, of any usage limits or pricing adjustments coming into effect. Since some resources are shared, usage of the API and creation of any entities will be generally subject to "fair use" limits. Please contact our team if you anticipate very heavy usage.

Intellectual Property: The platform and all content and materials included on it, such as text, graphics, logos, images, and software, are the property of us or our licensors and protected by copyright and trademark laws.

Disclaimer of Warranties: Joystick and all related services and information provided under the getjoystick.com domain or through our professional services team is provided on an "as is" and "as available" basis. We do not guarantee that the service will be uninterrupted or error-free. We make no warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose, regarding the platform or any services or products provided through it. Our team does the best it can to be prepared, however, service disruptions and degradation can and will happen. In some cases the disruption may be due to the 3rd party vendors, services and software that we rely on. We will consistently try to the best of our ability to maintain availability and notify you if there will be any anticipated interruptions.

Limitation of Liability: In no event shall we be liable for any damages whatsoever, including, but not limited to, direct, indirect, special, incidental, or consequential damages, arising out of or in connection with the use or inability to use our SaaS platform.

Indemnification: You agree to indemnify and hold us and our affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the platform, your violation of these terms of use, or your violation of any rights of another.

Unpaid Service Fees: Payments are considered overdue if they are not received by the due date specified in the invoice or 30 days after the relevant service has been provided. If a payment is overdue, a late payment fee of 5% per 30 day period will be added to the outstanding balance. If an Organization's payment is more than 14 calendar days overdue or the amount overdue is more than $5000 USD, we reserve the right to deactivate/suspend provision of services until the outstanding balance is paid in full. We will make reasonable efforts to contact Organization Owners of suspension or termination of service via the email address associated with their account. If an Organization's service is suspended or terminated due to non-payment, the account holder may request reinstatement of service by paying the outstanding balance in full. If an Organization's payment is more than 90 days overdue and the outstanding balance remains unpaid, or the overdue amount exceeds $5000 USD, we reserve the right to terminate the Organization's access to the platform and delete all data associated with the Organization.

Abandoned Accounts: An Organization will be considered "abandoned" if no user from the organization logins in and performs any actions for a trailing period of 90 days. We will make reasonable efforts to notify Organization Owners of account abandonment via the email addresses associated with the Organization. We reserve the right to, without notice, deactivate the service and/or permanently delete all data associated with Organizations that are considered "abandoned" after 30 days (120 days since last recorded activity on the platform by any member of the Organization).

Governing Law: These terms of use and your use of the platform are governed by and construed in accordance with the laws of the jurisdiction in which our company is based (Hong Kong), without giving effect to any principles of conflicts of law. Any disputes arising out of or relating to these terms or the platform will be resolved in the courts of Hong Kong.

Changes to Terms of Use: We reserve the right to make changes to these terms of use at any time. Your continued use of the platform following the posting of changes will mean you accept those changes.

By using the getjoystick.com website ("service"), or any services under the getjoystick.com domain, including app.getjoystick.com, docs.getjoystick.com, you are agreeing to be bound by the following privacy policy ("privacy policy"). If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity, its affiliates and all users who access our services through your account to these terms and conditions, in which case the terms "you" or "your" shall refer to such entity, its affiliates and users associated with it. If you do not have such authority, or if you do not agree with these terms and conditions, you must not accept this agreement and may not use the services. This Privacy Policy will be updated from time-to-time. We have no obligation, except where otherwise required by law, to notify you of such updates.

Who Are We?

Joystick is a Software-as-a-Service provider serving companies looking to integrate dynamic content and remote configuration into their product, app, game or system. Joystick provides a robust, feature-rich remote configuration solution that offers high availability, scalability, and audit controls.

In this document, we refer to our customers, Companies or individuals who utilize Joystick as members. We refer to the customers of those members as "users" or "end-users". "You" is used to refer to anyone reading this policy and can generically mean anyone who interacts with our website, a member of our services, or a user of one of our members.

This policy is primarily for with members regarding how we keep their data safe, and how we are allowed to use their data. If you are an end-user, then you should consult privacy policy of the member instead. This policy applies to the data as long as we retain the data.

We may receive or share your data from or to third parties as authorized by you explicitly. When you authorize the sharing of your data to a third party such data is subject to the privacy policy and associated terms presented by such third party. This policy does not cover third party websites, products, or services even if they link to our services.

If you disagree with the practices described in this policy, then you should take necessary steps to remove cookies from your computer after leaving our website, and discontinue your use of our services.

Data Collection

We receive some data directly or get data indirectly through third-party providers and technologies like cookies. The collection and use of data is essential to the value that Joystick provides as a service. We aim to do our best to keep data safe and secure. We collect information for the following reasons and not for other reasons

1. Personal Data

Data that identifies, or could be used to reasonably identify you is "Personal Data". Personal Data is collected in various ways, for example, when you register for accounts or interact with our team. Personal Data does not include data that has been anonymized, psuedonymised, or minimized such that it cannot be reasonably associated with a person.

Personal Data is used for: Identifying individuals and providing appropriate levels of access and service on our platform. To respond to inquiries, send service notices, and provide customer support. For audits, regulatory purposes, and compliance. To develop new products and improve our existing service and offerings. To send marketing communications. To conduct analysis and develop insights

We do not give, trade, sell or in any other way provide personal data to third parties without explicit consent and knowledge.

2. Service Data

Service Data is data that our members send to us about their users. Joystick allows our members to submit information to us about their end-users to enrich end-user experiences. Members who use Joystick have a responsibility to take the appropriate disclosures, precautions, and responsibilities regarding the content of the service data they provide to Joystick, its collection and usage.

We utilize service data for no purpose except to deliver the functionality that our platform provides to our members. We process and use this data, but do not collect or store this data.

3. Configuration Data

Configuration Data is the data that members input into our platform, either directly or programmatically via our APIs or connector tools, in order for our service to make available and serve over our APIs. We claim no ownership or authorship over such data. We utilize configuration data for no purpose except as directed by authorized members and to deliver the functionality that our platform provides to our members.

4. Other Data

"Other Data" is any other data that is not Personal Data, Configuration Data, or Service Data. Other Data is collected through various sources. One source is cookies and other technologies that record data about the use of our website. Other data that we may collect via third-party mechanisms include: Browser and device data, such as IP address, cookie identifier, website activity, device type, operating system and internet browser type, screen resolution, operating system name and version, device manufacturer and model, language, plug-ins, add-ons and the version of the Services you are using; Transaction data, such as purchases, purchase amount, date of purchase, and payment method that you have submitted to us as a course of ordering our services; Cookie and tracking technology data, such as time spent on the Services, pages visited, language preferences, and other anonymous traffic data; and Company data, such as a company's legal structure, product and service offerings, jurisdiction, company records, and information submitted to us by you in interacting with our team.

We utilize Other Data in a number of ways, but we comply with applicable law and contractual agreements. In some areas, like the European Economic Area Countries, we may be required to treat Other Data like Personal data. In areas where this is the case, we will process this data as if it were Personal data under our privacy policy.

Data Disclosure

Joystick does not sell, give, trade or transact any data to marketers or unaffiliated third parties. Data collected by Joystick will only used for the purposes of furthering, improving, and expanding the Joystick service.

Data may be used in the following ways:

To Service Providers. In order to deliver the services that make up Joystick, we rely on service providers (e.g. infrastructure providers, online document editing and storage services) to provide key functionality both in the operation of our product as well as the operation of the Joystick company. Any of the data types may be stored with Service Providers. We aim to select Service Providers with the highest-level of data protection measures. The full list of our Service Providers is available upon request to our Members.

To our members. We process and collate service data that is provided to us by our members in order to deliver the services to our members.

To Safety, Legal and Law Enforcement. We use and disclose data as we believe necessary under the applicable law, to enforce our own terms and conditions, to protect our rights, privacy, safety, or property, as well as to respond to requests from courts, law enforcement, regulatory agencies, and government authorities, which may include countries outside of your country of residence.

Security and Notification of Breaches

Joystick takes security very seriously. If you have reason to believe that your data or someone else's data known to Joystick is no longer secure, please contact privacy@getjoystick.com. In the event of a security breach, we will take necessary measures to ensure the continued safety of data and contact affected parties within a reasonable amount of time about the scope and scale of the unauthorized disclosure.

Use of Service by Minors

Joystick's services are not in anyway directed to minors and we request that minors do not provide to us any Personal Data.

Right to Access, View, or Remove Your Information

You have a right to access the personal information we hold about you. We may reject requests that are unreasonably repetitive, require disproportionate technical effort, are outside of our means, risk the privacy of others, or would be extremely impractical. You may request your information be removed from our systems. We protect information from accidental or malicious destruction so after data is removed from our servers, it can take some time for that data to be fully purged. To request removal of your Personal Information from our site or services, contact privacy@getjoystick.com.

Location

Joystick's services are distributed and thus Data, of all classifications, may be stored and processed where we or one of our service providers has services. We may transfer data to countries outside of your country of residence or operations, which may have different rules applicable to your data. Joystick will take measures to ensure that any transfers comply with applicable laws and your data remains protected as per this policy.
